Terms of Service

These Terms of Service ("Terms") govern your access to and use of foragecreditrelief.com (the "Site") and all related services, content, and features provided by Forage Credit Relief ("Forage," "we," "us," or "our"). Please read these Terms carefully. By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy.

If you do not agree to these Terms, do not use the Site.

1. About Forage Credit Relief

Forage Credit Relief is a consumer information and marketing service. Forage is not a lender, creditor, debt settlement company, credit counseling organization, credit repair organization, or financial advisor. Forage operates an online marketplace that connects consumers interested in debt consolidation and personal loan products with participating lenders, lead aggregators, financial service providers, and marketing partners (collectively, "Participating Partners").

Forage does not:

  • Make credit or lending decisions
  • Originate, fund, or service loans
  • Extend, arrange, or guarantee credit
  • Provide legal, tax, accounting, credit repair, debt settlement, or financial advice
  • Charge consumers any fees for using the Site or Services

All credit, loan, and financial decisions are made independently by Participating Partners based on their own underwriting criteria, rates, and terms. Rates, fees, terms, and availability of any financial product are determined solely by the applicable Participating Partner.

2. Eligibility

To use the Site, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction, if higher)
  • Be a legal resident of the United States with a valid U.S. mailing address
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited by applicable law or any prior agreement from using the Site or receiving marketing communications

If you do not meet these requirements, do not use the Site.

3. Your Information and Representations

When you submit information through the Site, you represent and warrant that:

  • All information you provide is accurate, truthful, current, and complete
  • You are providing your own personal information — not information about another individual
  • You are the authorized user of the telephone number(s) and email address(es) you provide
  • You have the legal authority to grant the consents described in our forms and Privacy Policy
  • You will promptly update your information if it changes

You understand and acknowledge that Participating Partners will rely on the accuracy of your information in determining whether to contact you or to offer credit, loan, or related products. Providing false, misleading, or unauthorized information may constitute fraud and may result in termination of your access to the Site, reporting to law enforcement, and other legal action.

4. Consent to Be Contacted

By checking the consent box on the form and submitting your information, you provide express written consent for Forage and Participating Partners to contact you at the telephone number(s) and email address(es) you provided, including via automatic telephone dialing systems, artificial or pre-recorded voice, SMS text messages, ringless voicemails, and email, for purposes of marketing debt consolidation, loan, credit, insurance, and related financial products.

Consent is not a condition of purchase. Message and data rates may apply. You may revoke consent at any time as described in our Privacy Policy.

5. No Warranty of Offers; No Guarantee of Credit Approval

Forage does not guarantee that any Participating Partner will contact you, make you an offer, approve you for credit, or provide any particular rate, term, or amount. Participating Partners may decline to offer products to any individual based on their own underwriting criteria, and Forage has no control over those decisions.

Any rate, APR, fee, loan amount, term, or payment example displayed on the Site is illustrative only, based on industry averages or Participating Partner disclosures, and is not an offer of credit. Actual rates and terms depend on your individual circumstances and are determined solely by the Participating Partner.

6. Credit Inquiries

Some Participating Partners may perform a soft credit inquiry to show you estimated rates or eligibility. Soft inquiries do not affect your credit score. If you choose to formally apply for a loan or credit product with a Participating Partner, that Partner may perform a hard credit inquiry, which may affect your credit score. Hard inquiries are performed by the Participating Partner under its own disclosures, not by Forage.

7. Fees

Forage does not charge consumers any fee for using the Site or Services. Forage is compensated by Participating Partners when consumers submit information or complete a loan or credit transaction. This compensation does not increase the cost of any product or service you may obtain from a Participating Partner.

8. License to Use the Site

Subject to your compliance with these Terms, Forage grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. You may not:

  • Reproduce, copy, scrape, modify, distribute, or create derivative works of any portion of the Site
  • Use any robot, spider, automated script, or other automated means to access the Site
  • Reverse-engineer, decompile, or disassemble any portion of the Site or its underlying technology
  • Submit false, misleading, or third-party information
  • Interfere with the operation of the Site, including by transmitting viruses, malware, or disruptive code
  • Use the Site in any manner that violates any applicable federal, state, or local law, regulation, or ordinance

9. Intellectual Property

The Site and all content on it — including text, graphics, logos, images, software, design, and the "Forage Credit Relief" name and mark — are owned by Forage or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

10. Third-Party Links and Services

The Site may contain links to websites, services, or content operated by Participating Partners or other third parties. Forage does not control and is not responsible for the content, privacy practices, or performance of third-party sites or services. Your use of any third-party site or service is at your own risk and is governed by that third party's own terms and privacy policy.

11. Disclaimers

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORAGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

FORAGE DOES NOT WARRANT THAT: (A) THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) INFORMATION ON THE SITE WILL BE ACCURATE, COMPLETE, OR CURRENT; (C) YOU WILL QUALIFY FOR, BE APPROVED FOR, OR RECEIVE ANY PARTICULAR RATE, TERM, OR PRODUCT FROM ANY PARTICIPATING PARTNER; OR (D) ANY PRODUCT OR SERVICE OFFERED BY A PARTICIPATING PARTNER WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FORAGE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF FORAGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL FORAGE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

13. Indemnification

You agree to defend, indemnify, and hold harmless Forage and its affiliates, officers, directors, employees, agents, and licensors from any claim, demand, loss, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any applicable law; (d) any false, misleading, or unauthorized information you submit; or (e) any claim by a Participating Partner or third party arising from actions you have taken in connection with the Site.

14. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

14.1 Informal Resolution

Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at legal@foragecreditrelief.com. We will attempt to resolve the dispute in good faith within thirty (30) days.

14.2 Binding Arbitration

If the dispute is not resolved informally, you and Forage agree to resolve any claim, dispute, or controversy arising out of or related to these Terms or your use of the Site through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, by a single arbitrator, and may be conducted by telephone, video conference, or in writing at the arbitrator's discretion.

14.3 Class Action Waiver

YOU AND FORAGE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found to be unenforceable, then the entirety of this Section 14 is null and void.

14.4 Exceptions

Either party may bring an individual action in small claims court or seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property rights.

14.5 Opt-Out

You may opt out of the arbitration and class action waiver provisions by sending written notice to legal@foragecreditrelief.com within thirty (30) days of first accepting these Terms. The notice must include your full name, mailing address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect the remainder of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Except for disputes subject to arbitration under Section 14, any legal action must be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

16. Termination

Forage may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, all rights granted to you under these Terms will immediately cease. The provisions of these Terms that by their nature should survive termination (including Sections 9, 11, 12, 13, 14, 15, and 18) will survive.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page and post the revised Terms on the Site. Material changes will be communicated by posting a prominent notice on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

18. Miscellaneous

  • Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and Forage regarding the Site and supersede any prior agreements.
  • Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver. Forage's failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
  • Assignment. You may not assign or transfer these Terms. Forage may assign these Terms without restriction.
  • Notices. Notices to Forage must be sent to legal@foragecreditrelief.com. Notices to you may be sent to the email address you provided or posted on the Site.
